Trendful Privacy Policy

How Trendful handles your data.

Introduction

In our mission to make starting and scaling a resale business easier for everyone, Trendful collects and uses information about you, our:

  • Clients using Trendful to run their resale business;
  • Sellers (customers) who are selling pre-owned products to a Trendful-powered resale business; and
  • Visitors to Trendful’s websites, and anyone who contacts Trendful support.

This Privacy Policy helps you understand how we collect, use, and share your personal information. It is organized as a general policy that applies to everyone, followed by three parts that provide additional detail for Clients (Part A), Sellers/customers (Part B), and Visitors and support contacts (Part C). We may update this Privacy Policy if we change our privacy practices. If any changes are significant, we will let you know via the email address we have on file or through your Trendful Admin Account, and we will update the “Last updated” date above.

Our values

Trust is at the heart of Trendful’s recommerce software, which includes trusting us to do the right thing with your information. These values should help you understand how we think about your information and your privacy.

Your information belongs to you

We carefully analyze the types of information we need to provide our services, and we try to limit what we collect to only what we really need. When possible, we delete or anonymize this information when it is no longer needed. Our engineering team builds with privacy in mind. Our guiding principle is that your information belongs to you and that we aim to use it for your benefit.

Your information is protected from others

If your personal information is requested by a third party, we will refuse to share it unless you have previously given us permission or we are legally required to share it. Where we are legally required to share your personal information, we will notify you in advance unless we are legally prohibited from doing so.

Why we process personal information (legal bases)

Where the GDPR or UK GDPR applies, we process personal information on the following legal bases:

  • Performance of a contract – for example, to process your subscription payments and provide Trendful’s software;
  • Legitimate interests – for example, to prevent risk and fraud, to answer questions and provide support, to provide and improve our products and services, to provide reporting and analytics, and to test features, in each case after weighing those interests against your privacy;
  • Compliance with legal obligations – for example, tax, “know your customer,” anti-money-laundering, and similar requirements; and
  • Consent – for example, for certain cookies and marketing, where required. Where we rely on consent, you may withdraw it at any time.

International data transfers

Trendful is based in the United States, and we and our service providers may Process your personal information in the United States and other countries. Where we transfer personal information from the European Economic Area, the United Kingdom, or Switzerland to a country that has not been recognized as providing an adequate level of protection, we rely on the Standard Contractual Clauses approved by the European Commission, applied with the UK International Data Transfer Addendum and the Swiss amendments where relevant. A copy is available on request, and the details are set out in our Data Processing Addendum. Several of the providers we use are also certified under the EU-U.S. Data Privacy Framework; the safeguard that applies to each is listed on our subprocessors page.

Your rights over your information

Depending on how you use Trendful and where you are located, you may have the right to request access to, correct, amend, delete, port, restrict, or object to certain uses of your personal information.

If you sold a pre-owned product to a Trendful-powered resale business and wish to exercise rights over information about your sale, you generally need to contact the Trendful Client you interacted with, because that Client controls your information (see Part B).

If you are a Client, Trendful employee, or another individual with whom Trendful has a direct relationship, you can submit a data subject request through your Trendful Admin Account or by contacting us at contact@trendful.com. Because we must be sure it is you making the request, we may need to verify your identity, including through a third-party verification provider.

If you are located in the EEA, the United Kingdom, or Switzerland, you also have the right to lodge a complaint with your local data protection supervisory authority.

How we protect your information

It is our mission to protect your personal information and to ensure the security and integrity of our platform. However, no method of transmission over the internet and no method of electronic storage can be guaranteed to be 100% secure, so we cannot guarantee the absolute security of your personal information.

Cookies and similar technologies

We use cookies and similar technologies on our website and when providing our products and services, including when we power a Client’s Resale App and Sell Form. For details about the cookies we use and your choices, please see our Cookie Policy.

Data retention

We keep personal information for as long as needed to provide the Services and for the purposes described in this Privacy Policy, after which we delete or anonymize it. Retention for Client Accounts follows the data retention and deletion lifecycle in Section 25.6 of our Terms of Service, summarized in Part A. We may retain information longer where a hold applies (such as an unpaid balance, open payout, open shipping or insurance claim, or open dispute) or where we are legally required to retain it. After we anonymize personal information, we may continue to use non-identifiable information to improve our services.

California privacy

We do not and will not “sell” your personal information, and we do not “share” it for cross-context behavioral advertising, as those terms are used under the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA”). We do not run advertising or retargeting technologies, and we do not disclose personal information to advertising networks.

Part A – Privacy for Clients

For clients using Trendful to start and scale their resale business.

Introduction

If you are a Client using Trendful to run your resale business, we collect and use your personal information to provide you with our products and services and, in general, to help you manage your resale business and your relationship with your sellers (customers). This Part A supplements the general Privacy Policy above.

What information we collect about you and why

We collect personal information when you sign up for Trendful, when you use our products and services, or when you otherwise provide us information. We may also use a third-party service provider to help us review accounts for fraud or other concerns. In general, we need this information for you to use our products and services.

When and why we share your information with others

We work with a variety of companies to help us provide you with the Services, and we sometimes share your personal information with them for that purpose. We may also share your personal information:

  • To prevent or investigate suspected fraud, threats to physical safety, illegal activity, or violations of a contract (such as our Terms of Service) or our policies (such as our Acceptable Use Policy);
  • To help us conduct marketing and advertising;
  • To comply with legal requirements or respond to court orders or similar government demands; and
  • If we merge with or are acquired by another company.

Your rights over your information

You can access and correct much of your personal information directly in your Trendful Admin Account. For information you cannot access or correct there, contact contact@trendful.com to submit a data subject request.

We generally keep your personal information while you use Trendful. If you close your Account, stop paying your subscription fees, or we terminate your Account, we retain your Account information during the retention window described in Section 25.6 of our Terms of Service (currently ninety (90) days following termination), during which you may request reactivation or an export of your data, after which we begin the personal information purge process. For Accounts that register but never activate a paid subscription and show no meaningful activity, meaning no subscription is ever started and no items, listings, or customers are ever submitted, we may close the Account and delete the personal information associated with it after thirty (30) days, without contacting you first. The retention window above exists so that an Account with a billing or submission history can be reactivated and so records remain available if a complaint or audit follows; an Account that was never used has no such history to preserve. We also close and delete Accounts created through automated sign-ups, or otherwise in abuse of our sign-up form, including Accounts created on behalf of someone who did not request one, at any time and without notice, as described in Section 25.6 of our Terms of Service. If you contact us to request deletion, we will begin the purge process after any applicable retention window, except where we are legally required to retain specific information, and subject to any holds (such as an unpaid balance, open payout, open shipping or insurance claim, or open dispute). After we anonymize your personal information, we may continue to use non-identifiable information to improve our services.

We do not and will not “sell” or “share” your personal information as those terms are used under the CCPA, except as disclosed in this Privacy Policy and our Cookie Policy.

Your sellers’ (customers’) information

In order for you to run your resale business, we collect and use personal information about your sellers (customers). In general, we only collect and use this personal information as directed by you and as further described in our Data Processing Addendum. With respect to that information, we are a “data processor” and a “service provider” as those terms are defined under European and California privacy laws. We will not use your sellers’ (customers’) information to independently market or advertise to them unless they are also using one of our products or services directly.

Because you decide how your sellers’ (customers’) personal information is used, you are responsible for making sure they understand how you (and we, on your behalf) collect and process their personal information, at a minimum by posting a privacy policy on your website that describes the information you collect, how you use it, and who you share it with.

Part B – Privacy for Sellers (Customers)

For sellers (customers) who sell or consign pre-owned products to Trendful-powered resale businesses.

Introduction

Trendful provides software that our Clients use to run their resale businesses. If you have visited or sold pre-owned products to a Client’s Trendful-powered resale business, we collect and use information about you on behalf of that particular Client, and only at that Client’s direction. If you have questions about how a specific Client uses your information, please review that Client’s privacy policy.

Trendful will never use your personal information to independently market or advertise to you, unless you are also using one of our products or services directly.

We use service providers to help us provide services to our Clients. Outside of these service providers, we will only share your information if we are legally required to do so (for example, in response to a legally binding court order or subpoena) or where a Client instructs us to share information on their behalf. If you have questions about how a Client shares your personal information, please review that Client’s privacy policy.

Your rights over your information

When you visit or sell a pre-owned product to a Client’s Trendful-powered resale business, that Client legally controls your information. As a result, Trendful does not, for example, decide how long your information is retained, because that decision is made by the Client. This means Trendful cannot help you access, correct, erase, or port your information without being directed to do so by the Client. To make a request about your personal information, please contact the specific Client directly. If you make a request to us, we will forward it to the relevant Client and help them fulfill it. If the Client no longer exists, we may be able to assist you directly. We also do not and will not “sell” or “share” your information as those terms are used under the CCPA.

Part C – Privacy for Visitors and Support Contacts

For people who visit Trendful’s website or contact Trendful support.

Introduction

If you visit Trendful’s website or contact Trendful support, we generally use your personal information to provide you with the specific service you are using. This Part C supplements the general Privacy Policy above.
