Shipping Terms of Service
These Shipping Terms (“Shipping Terms”) govern your use of Trendful’s shipping-related services (“Trendful Shipping”) and supplement the Trendful Terms of Service and the Privacy Policy. By using Trendful Shipping, you agree to these Shipping Terms. Any new features or tools that are added to Trendful Shipping shall also be subject to these Shipping Terms. Trendful reserves the right to update and change the Shipping Terms by posting updates and changes. You can review the current version of the Shipping Terms at any time. You are advised to check the Shipping Terms from time to time for any updates or changes that may impact you.
1. Trendful Shipping Overview
You must read, agree to, and accept these Shipping Terms before using Trendful Shipping. By using Trendful Shipping, you agree to comply with all applicable policies, procedures, and instructions provided by Trendful from time to time.
If you do not agree to these Shipping Terms or any applicable procedures, you must not use Trendful Shipping.
Trendful Shipping allows Clients to access shipping services offered by third-party carriers, including the United States Postal Service ("USPS"), United Parcel Service ("UPS"), Canada Post, and FedEx (each a "Carrier," and collectively, the "Carriers"), directly through the Trendful platform.
Trendful Shipping enables Clients to:
- Purchase shipping services and generate shipping labels;
- Enable Client’s customers to create shipping labels and add insurance;
- Automatically generate shipping labels based on configured preferences and resale workflows;
- Use Carrier services without maintaining separate Carrier accounts.
Trendful may automatically generate shipping labels in connection with offers or transactions initiated through the Trendful resale application, based on the Client’s configured settings.
All Carrier services are provided by the applicable Carrier and are subject to the Carrier’s terms and conditions.
2. Role of Trendful
Trendful serves solely as an intermediary between you and the applicable shipping carrier, allowing you to purchase shipping services, postage, and shipping labels ("Labels") for your sellers or customers.
Trendful does not pick up, transport, deliver, or otherwise handle shipments. All shipments are fulfilled by third-party carriers.
You are responsible for sending Labels to your sellers or customers unless a shipping label is automatically generated through the Trendful resale application.
3. Billing and Payment for Shipping Services
3.1. Billing Responsibility
All shipping charges incurred through Trendful Shipping are billed solely to the Client. Trendful does not charge or collect shipping fees from the Client’s customers or sellers.
If a Client enables functionality that allows its customers or sellers to generate shipping labels, the Client remains fully responsible for all associated shipping charges, fees, and adjustments.
Trendful does not act as a merchant of record for shipping transactions between Clients and their customers.
3.2. Timing of Charges
Shipping and insurance charges are automatically billed to the Client’s default payment method on file when a shipping label is scanned by the Carrier and enters transit.
Charges are calculated based on Carrier rates and the shipment information provided at the time the label is created.
3.3. Shipping Adjustments
In certain cases, shipping charges may be adjusted after shipment, including but not limited to:
- Carrier rate adjustments due to actual package weight or dimensions
- Incorrect or incomplete shipment information
- Failed or declined payment attempts
Trendful will notify Clients of any such adjustments via email. Any resulting charges will be applied to the Client’s default payment method on file.
3.4. Payment Authorization
Clients are responsible for maintaining valid and up-to-date payment information. Trendful is not responsible for delays, failed shipments, or service interruptions caused by declined or invalid payment methods.
3.5. Suspension for Non-Payment
Trendful reserves the right to suspend or restrict access to Trendful Shipping, including the ability to generate shipping labels, if any shipping charges, fees, or adjustments remain unpaid or if a Client’s payment method fails.
Suspension may occur immediately and without prior notice until all outstanding amounts are paid and a valid payment method is on file. Trendful shall not be responsible for any delays, failed shipments, or business interruption resulting from suspension due to non-payment.
3.6. No Refunds for Completed Shipments
Shipping charges are non-refundable once a shipping label has been scanned by a carrier or otherwise used in transit, except as required by applicable law or expressly approved by the applicable carrier or insurance provider.
3.7. Currency and Processing
Shipping charges are generally processed in U.S. Dollars. However, shipments processed through Canada Post are charged in Canadian Dollars (CAD).
Clients are responsible for any foreign exchange fees, bank fees, or payment processing fees imposed by their financial institution in connection with shipping charges, including any currency conversion fees.
4. Customer-Initiated Shipping
Clients may, at their discretion, enable functionality that allows their customers or sellers to generate shipping labels through the Trendful platform.
When enabled:
- Labels and insurance selections are initiated by the Client’s customer or seller based on the Client’s preferred carrier
- All charges are billed to the Client
- Trendful does not guarantee delivery outcomes
- Trendful is not responsible for customer errors or misuse
This feature may be enabled or disabled by the Client at any time.
5. Client-Initiated Return Labels
Clients may generate return Labels within their admin account for inventory or items received through Trendful Shipping, or otherwise in the Client’s possession, in order to return such items to a seller, customer, or other designated recipient.
When a Client generates a return Label:
- All shipping and insurance charges are billed to the Client in accordance with Section 3;
- The Client is solely responsible for the accuracy of all return shipment information, including recipient address, contents, weight, dimensions, and declared value;
- The Client is solely responsible for properly packaging the item being returned and for ensuring it complies with all applicable Carrier Terms;
- Where insurance is available and selected, the insured value is determined in accordance with Section 6; if no resale estimate or offer value is associated with the item, the Client is responsible for entering an accurate declared value, subject to EasyPost’s coverage limits;
- The filing deadlines in Section 7 apply and run from the return Label creation date;
- Trendful does not guarantee delivery outcomes and is not responsible for the condition, packaging, or contents of items returned by the Client, or for any loss, damage, or delay in return shipments.
This feature may be enabled or disabled by Trendful at any time.
6. Shipping Insurance
Shipping insurance, where available, is provided by EasyPost Shipping Insurance and not by Trendful. Trendful is not a licensed insurance producer and does not underwrite or guarantee insurance coverage.
6.1. Insurance Charges
If shipping insurance is selected, the insurance fee is charged when the shipping label is scanned by the Carrier and enters transit, and is billed to the Client’s default payment method on file.
Insurance is priced at 1% of the insured value, up to a maximum insurable value of $5,000 per shipment, subject to EasyPost’s coverage limits and terms.
6.2. Automatic Insurance Calculation
When insurance is enabled, and a label is created:
- The insured value is calculated based on the resale estimate, if available
- If no resale estimate exists, the insured value is calculated based on the offer value
Example:
If an item has a resale estimate of $1,400 and an accepted offer of $700, the insured value will be $1,400, and the insurance cost will be $14.
7. Shipping Claims
All claims related to lost, damaged, or delayed shipments, including insurance claims, must be submitted through Trendful Support, not directly to the Carrier or insurance provider.
Trendful will facilitate submission of claims to the applicable Carrier or insurance provider; however:
- Claim approval and reimbursement decisions are made solely by the Carrier or insurer
- Trendful does not guarantee claim approval or payment
- Claims may be denied for reasons outside of Trendful’s control
Clients are responsible for providing all required documentation in a timely manner.
Trendful’s role in the claims process is limited to facilitating submission and communication with the applicable Carrier or insurance provider.
7.1. Claims Payment and Reimbursement Process
If a shipping or insurance claim is approved by the applicable carrier or insurance provider, any reimbursement or settlement payment will be issued directly to Trendful, as Trendful maintains the carrier and insurance accounts.
Such payments are typically issued by check and may take up to three (3) weeks or longer to be received, depending on the carrier or insurance provider.
Upon receipt of the claim payment, Trendful will credit the Client’s account for the approved amount, less any applicable fees or adjustments.
The Client is solely responsible for reimbursing or compensating its customers or sellers for any approved claims. Trendful does not make payments directly to customers or sellers and does not assume responsibility for the distribution of claim proceeds.
7.2. Claims Review Timeline
Claims submitted to carriers or insurance providers are subject to the review and processing timelines of the applicable carrier or insurer. Depending on the carrier or insurer and the nature of the claim, the review and resolution process may take between six (6) and eight (8) weeks, or longer in some cases.
Trendful does not control claim processing timelines and is not responsible for delays in claim review, approval, or payment by the carrier or insurance provider.
7.3. EasyPost Insurance Claims – Definitions and Filing Deadlines
This subsection applies only to shipping insurance claims provided through EasyPost Shipping Insurance and does not apply to claims submitted directly to shipping carriers.
Shipping insurance provided through EasyPost covers packages that are lost, damaged, or stolen after entering the carrier’s mail stream, subject to EasyPost’s terms and conditions.
For purposes of EasyPost insurance claims only:
- Lost: A package that began tracking but has no delivery scan
- Damaged: A package that was delivered but whose contents were damaged
- Stolen: A package that shows a delivery scan but was not received
EasyPost insurance claims must be submitted within the following timeframes:
- Lost shipments: Must be filed between fifteen (15) and sixty (60) days after the label creation date (up to ninety (90) days for international shipments)
- Damaged or stolen shipments: Must be filed within thirty (30) days of the label creation date
Claims submitted outside of these timeframes may be denied by EasyPost and will not be eligible for reimbursement.
Clients are responsible for notifying Trendful and submitting all required documentation in sufficient time to allow Trendful to meet EasyPost’s filing deadlines.
8. Returned or Undeliverable Shipments
Because Trendful maintains the carrier accounts used to generate shipping labels, packages that are refused, undeliverable, misrouted, or otherwise returned by a carrier may be sent to Trendful’s designated return address.
If Trendful receives a returned or undeliverable package:
- Trendful will notify the Client upon receipt;
- Trendful may open the package solely for the purpose of verifying the contents and confirming that the returned item matches the original shipment;
- Trendful does not assume ownership of the contents and does not guarantee the condition of the item beyond reasonable handling;
- Upon verification, Trendful will arrange for the item to be reshipped either to the Client or to the Client’s customer or seller, as directed by the Client.
Any shipping, handling, storage, or reshipment fees associated with returned or undeliverable packages will be billed to the Client and included in the Client’s next shipping adjustment.
Trendful is not responsible for delays, losses, or damages resulting from carrier handling, incorrect or incomplete addresses, refused deliveries, or other circumstances beyond Trendful’s reasonable control.
9. Carrier Terms and Compliance
Trendful provides access to shipping services offered by third-party carriers. All shipping services are provided solely by the applicable carrier and are subject to that carrier’s terms, conditions, rules, and policies (collectively, "Carrier Terms").
Clients are solely responsible for reviewing, understanding, and complying with all applicable Carrier Terms, including but not limited to restrictions on items shipped, packaging requirements, labeling requirements, service limitations, and prohibited or restricted goods.
Trendful does not guarantee carrier performance, delivery times, delivery outcomes, or compliance determinations made by any carrier.
9.1. United States Postal Service (USPS)
Use of USPS postage is subject to all applicable USPS rules, regulations, and policies, including USPS mailing standards, shipping restrictions, and packaging and labeling requirements.
If USPS postage is used, Trendful will share shipment information with USPS as necessary to facilitate the purchase of postage and shipment processing.
USPS Privacy Act Statement:
Your information will be used to facilitate the purchase of U.S. Postal Service (USPS) postage and fulfill USPS transactional and reporting requirements. Collection is authorized by 39 U.S.C §§ 401, 403, and 404. Providing the information is voluntary; however, failure to provide required information may result in the inability to process a shipment. USPS may disclose information as permitted by law to complete transactions, respond to lawful requests, or engage service providers assisting fulfillment. 9.2. UPS, FedEx, and Canada Post
Use of UPS, FedEx, or Canada Post shipping is subject to the applicable carrier’s terms and conditions, including but not limited to:
- UPS Tariff and Terms and Conditions of Service
- FedEx Terms of Use and Service Guide
- Canada Post Terms of Use and Conditions of Service
Clients acknowledge that carrier rules, rates, service levels, and eligibility requirements may change at any time and that Trendful does not control or guarantee such changes.
9.3. Carrier Determinations and Enforcement
Carriers may, at their discretion:
- Refuse or cancel shipments
- Adjust shipping charges
- Reclassify services
- Inspect packages
- Impose surcharges or penalties
- Delay, return, or dispose of shipments
Trendful is not responsible for carrier enforcement actions, determinations, inspections, refusals, or adjustments, even if such actions result in additional fees, delays, or failed deliveries.
Any carrier-imposed charges, penalties, or adjustments resulting from shipment characteristics, non-compliance, or inaccurate information provided by the Client will be billed to the Client.
9.4. No Carrier Relationship
Nothing in these Shipping Terms creates a partnership, agency, joint venture, or employment relationship between Trendful and any carrier. Trendful does not act as an agent of the carrier and does not assume responsibility for carrier obligations, decisions, or performance.
9.5. Conflicts with Carrier Terms
In the event of a conflict between these Shipping Terms and the applicable Carrier Terms, the Carrier Terms shall govern with respect to shipping services provided by that carrier.
10. Taxes, Duties, and Customs
Clients are solely responsible for determining, paying, and complying with all applicable taxes, customs, duties, import fees, export fees, value-added taxes (VAT), brokerage fees, and any other governmental charges related to their shipments (collectively, "Customs Charges").
Trendful does not calculate, collect, remit, or advise on Customs Charges and makes no representations regarding the applicability, accuracy, or amount of any such charges.
If any Customs Charges are assessed to Trendful by a carrier, customs authority, or other governmental entity in connection with a Client’s shipment, the Client agrees to reimburse Trendful in full for such charges within seven (7) days of notice.
Trendful is not responsible for delays, returns, seizure, forfeiture, or disposal of shipments resulting from unpaid Customs Charges, incorrect documentation, misclassification of goods, inaccurate declared values, or failure to comply with applicable customs laws or regulations.
Clients are responsible for ensuring that all shipment information, including descriptions, values, harmonized tariff codes (if applicable), and destination details, is accurate and complete.
11. Restrictions on Use
Clients may use Trendful Shipping solely for lawful business purposes in connection with services offered through the Trendful platform in compliance with these Shipping Terms, the Terms of Service, and all applicable laws and carrier requirements.
Without limiting the foregoing, Clients may not:
- Use Trendful Shipping to ship any prohibited, restricted, hazardous, dangerous, illegal, or non-compliant goods, or any items that violate applicable Carrier Terms or applicable law;
- Provide false, inaccurate, incomplete, or misleading shipment information, including package weight, dimensions, contents, declared value, or destination;
- Understate or misrepresent the value of shipped items to reduce shipping or insurance charges, or overstate value to inflate a potential claim;
- Submit false, fraudulent, or duplicate claims, or claims for shipments not sent through Trendful Shipping;
- Use Trendful Shipping for any purpose other than lawful resale business conducted through the Trendful platform, including personal shipments or shipments unrelated to the Client’s resale operations;
- Resell, sublicense, rent, or otherwise provide access to Trendful Shipping, shipping rates, or Labels to any third party, or use the service to ship on behalf of another business;
- Circumvent, disable, manipulate, or interfere with billing, insurance calculation, claims processing, or any other function of Trendful Shipping;
- Use Trendful Shipping in violation of any applicable export control, sanctions, or trade law;
- Attempt to gain unauthorized access to, reverse engineer, or disrupt Trendful Shipping or the systems of any Carrier or insurance provider.
Trendful reserves the right to suspend or terminate access to Trendful Shipping for violations of this Section 11, misuse of the service, or activity that Trendful reasonably believes may create risk, liability, or non-compliance.
12. Disclaimer of Warranties
TRENDFUL SHIPPING IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRENDFUL MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, WITH RESPECT TO TRENDFUL SHIPPING OR ANY SHIPPING SERVICES, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT;
- WARRANTIES ARISING FROM COURSE OF DEALING, COURSE OF PERFORMANCE, OR USAGE OF TRADE;
- WARRANTIES REGARDING AVAILABILITY, RELIABILITY, TIMELINESS, ACCURACY, COMPLETENESS, OR SECURITY;
- WARRANTIES THAT SHIPMENTS WILL BE DELIVERED ON TIME, UNDELIVERED, UNDAMAGED, OR AT ALL;
- WARRANTIES THAT SHIPPING RATES, FEES, OR ESTIMATES WILL NOT CHANGE;
- WARRANTIES THAT CARRIER OR INSURANCE CLAIMS WILL BE APPROVED OR PAID.
TRENDFUL DOES NOT WARRANT OR GUARANTEE THE PERFORMANCE, SERVICES, DECISIONS, OR OUTCOMES OF ANY CARRIER, INSURANCE PROVIDER, OR THIRD PARTY, INCLUDING USPS, UPS, FEDEX, CANADA POST, OR EASYPOST.
WITHOUT LIMITING THE FOREGOING, TRENDFUL DOES NOT WARRANT THAT:
- SHIPPING SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF DELAYS;
- SHIPPING LABELS WILL BE ACCEPTED OR HONORED BY A CARRIER;
- SHIPMENTS WILL NOT BE LOST, DAMAGED, DELAYED, RETURNED, OR SEIZED;
- ANY CLAIM, REFUND, CREDIT, OR REIMBURSEMENT WILL BE ISSUED.
YOU ACKNOWLEDGE AND AGREE THAT YOUR USE OF TRENDFUL SHIPPING IS AT YOUR SOLE RISK AND DISCRETION, AND THAT YOU ARE RESPONSIBLE FOR DETERMINING WHETHER TRENDFUL SHIPPING AND ANY ASSOCIATED CARRIER SERVICES ARE SUITABLE FOR YOUR NEEDS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRENDFUL, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE;
- LOSS, DAMAGE, DELAY, MISDELIVERY, NON-DELIVERY, RETURN, SEIZURE, OR CONFISCATION OF SHIPMENTS;
- DENIED, DELAYED, OR REDUCED CLAIMS, REFUNDS, OR REIMBURSEMENTS;
- COSTS OF COVER, SUBSTITUTE SERVICES, OR ALTERNATIVE SHIPPING ARRANGEMENTS.
ARISING OUT OF OR IN CONNECTION WITH TRENDFUL SHIPPING, INCLUDING BUT NOT LIMITED TO THE USE OF SHIPPING LABELS, CARRIER SERVICES, INSURANCE, CLAIMS HANDLING, OR THIRD-PARTY ACTIONS, WHETHER BASED IN CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE, OR ANY OTHER LEGAL THEORY, EVEN IF TRENDFUL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13.1. Aggregate Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRENDFUL’S TOTAL AGGREGATE LIABILITY TO A CLIENT FOR ANY AND ALL CLAIMS ARISING OUT OF OR RELATING TO TRENDFUL SHIPPING SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY THE CLIENT TO TRENDFUL FOR SHIPPING SERVICES GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO LIABILITY.
13.2. Third-Party Services
Trendful shall not be liable for the acts, omissions, decisions, performance, or failures of any carrier, insurance provider, or other third party, including but not limited to USPS, UPS, FedEx, Canada Post, or EasyPost.
Any liability relating to carrier services or insurance coverage shall be governed solely by the applicable carrier’s or insurance provider’s terms and conditions.
13.3. Basis of the Bargain
You acknowledge and agree that the limitations of liability set forth in these Shipping Terms reflect a reasonable allocation of risk and form an essential basis of the bargain between you and Trendful.
You further acknowledge that Trendful would not be able to provide Trendful Shipping without these limitations.
14. Indemnification
You agree to indemnify, defend, and hold harmless Trendful, its affiliates, and their respective officers, directors, employees, agents, contractors, and partners from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use or misuse of Trendful Shipping, including shipping labels, postage, insurance, or claims processes;

Any shipment sent using Trendful Shipping, including the contents, packaging, labeling, declared value, destination, or compliance with applicable laws or carrier requirements;

Your violation of these Shipping Terms, the Terms of Service, or any applicable carrier, insurance provider, or third-party terms;

Your failure to pay shipping charges, fees, adjustments, customs duties, taxes, or other amounts owed;

Any inaccurate, misleading, incomplete, or fraudulent information provided by you or on your behalf in connection with a shipment;

Any claim, dispute, or demand brought by your customers, sellers, recipients, or other third parties relating to a shipment, including claims for loss, damage, delay, non-delivery, or reimbursement;

Any prohibited, restricted, hazardous, illegal, or non-compliant items shipped using Trendful Shipping.
14.1. Indemnification Process
Trendful will provide you with prompt written notice of any claim subject to indemnification, provided that failure to give prompt notice shall not relieve you of your indemnification obligations except to the extent you are materially prejudiced.
Trendful reserves the right, at its option, to assume the exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate fully with Trendful in asserting any available defenses.
You may not settle any indemnified claim without Trendful’s prior written consent if such a settlement would impose any obligation, admission, or liability on Trendful.
14.2. Survival
The provisions of these Shipping Terms that by their nature should survive termination or expiration — including but not limited to billing and payment obligations for charges incurred prior to termination, Shipping Claims, Disclaimer of Warranties, Limitation of Liability, Indemnification, and General Terms — shall survive any termination or expiration of these Shipping Terms or your access to Trendful Shipping.
15. General Terms
15.1. Modification or Termination of Shipping Services
Trendful reserves the right to modify, suspend, or terminate Trendful Shipping, or your ability to use Trendful Shipping, at any time, for any reason, with or without notice.
15.2. Privacy
You acknowledge and agree that your use of Trendful Shipping, including any information transmitted to or stored by Trendful, is governed by Trendful’s Privacy Policy.
15.3. Governing Law and Jurisdiction
These Shipping Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to its conflict of laws principles.
The parties irrevocably and unconditionally submit to the exclusive jurisdiction of the state and federal courts located in the State of Florida with respect to any dispute or claim arising out of or in connection with these Shipping Terms.
15.4. Amendments
Trendful may amend these Shipping Terms at any time by posting updated amended terms. Such amendments are effective as of the date of posting. Your continued use of the Trendful Shipping after the amended Shipping Terms are posted constitutes your acceptance of the amended terms. If you do not agree to any changes, you must discontinue use of Trendful Shipping.
15.5. Waiver
The failure of Trendful to exercise or enforce any right or provision of these Shipping Terms shall not constitute a waiver of such right or provision.
15.6. Severability
If any provision of these Shipping Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.
